Privacy Notice for TryOn

1. Introduction

This Privacy Notice for TRYON LLC (doing business as "TryOn") explains how and why we collect, store, use and share personal information when you use our mobile application and related services ("Services"). The Services include our AI‑powered virtual fitting room, virtual wardrobe integration and social sharing features. By using the Services, you consent to the practices described in this policy. If you do not agree with our policies and practices, please do not use the Services.

Unless otherwise noted, this policy applies only to residents of the United States. If you access the Services from outside the U.S., you understand that your data will be processed and stored in the United States. This policy replaces and supersedes any prior privacy notices provided through the TryOn application.

2. What Information We Collect

We collect personal information that you voluntarily provide when you register, use or interact with the Services. This may include your name, email address, phone number, username, password, date of birth (for age verification), payment information and any photographs or clothing images you upload. We also collect information about your communications with us, preferences and other account details. You are not required to provide any information to us, but certain features may not work without it.

We may automatically collect certain device information when you access or use the Services, such as your IP address, device type, operating system, app version and usage statistics. We do not intentionally collect sensitive personal information (such as race, ethnicity, religious beliefs, sexual orientation, or health information) and we ask that you do not send such data through the Services.

If you choose to register or log in using a social media account (e.g., Apple, Google or another identity provider), we may collect limited profile information (such as your name and email address) from that account in accordance with the provider’s privacy policy. We do not control how those providers process your data and encourage you to review their privacy notices.

3. How We Use Your Information

We use your personal information to operate, maintain and improve the Services. This includes creating and maintaining your account, enabling virtual try‑on and wardrobe features, personalizing content and recommendations, processing purchases or subscriptions, providing customer support and communicating with you about your account. We also use the information to protect the security of the Services, to detect and prevent fraud, to comply with legal obligations and to improve our products and user experience.

With your consent where required by law, we may use certain information for marketing purposes, such as sending newsletters or promotional messages. You can opt out of marketing emails at any time by following the instructions in those emails. We do not use your personal images or other sensitive information for advertising or sell your personal information to third parties.

We may create aggregated or de‑identified data from your information (for example, by removing personal identifiers) and use or share it for our business purposes, such as analyzing usage patterns or improving our products. Aggregated or de‑identified data does not identify you individually.

4. When and With Whom We Share Your Information

We may share your personal information with third‑party service providers who assist us in operating the Services. These providers may include cloud hosting platforms (for example, providers of data storage and computing services), analytics providers that help us understand how the Services are used, payment and subscription processors (such as Apple App Store, Google Play or other platform billing partners) and image processing partners that combine your photos with clothing images to generate try‑on results. We share only the information necessary for these partners to perform their services, and they are contractually obligated to protect your data and use it solely for our purposes.

We may also disclose your information to our professional advisors (such as auditors and legal counsel), regulatory authorities or law enforcement when required by law or to protect our rights, safety or property. In the event of a merger, acquisition or sale of all or a portion of our business, personal information may be transferred to the acquiring entity, subject to applicable law.

TRYON LLC does not sell personal information in exchange for money or other valuable consideration. However, some states consider sharing data with certain analytics or advertising partners to be a "sale" or "share" of personal information. To the extent our use of tracking technologies constitutes a sale or share under state privacy laws, you may opt out of this sharing by following the instructions in Section 9 ("Your Privacy Rights") below or by visiting a "Do Not Sell or Share My Personal Information" link in the Services. We do not knowingly sell or share the personal information of consumers under 16 years of age.

5. Cookies and Tracking Technologies

We and our partners use cookies, mobile device identifiers and similar technologies (collectively, "cookies") to recognize your device, remember your preferences, analyze usage and deliver personalized content or advertising. Most web browsers and mobile devices allow you to manage cookie preferences through settings; you can choose to disable cookies, but doing so may affect your experience with the Services.

At present there is no universally accepted industry standard for responding to Do‑Not‑Track (DNT) signals, and we do not respond to DNT signals. We will update this policy if a standard for recognizing DNT signals is established in the future. We do respond to global privacy control (GPC) signals that indicate your desire to opt out of the sale or share of your personal information, as required under state law.

6. AI Processing and Third‑Party Services

To provide virtual try‑on functionality, we process user images using third‑party AI services, including FashnAI.

Data Shared
We may transmit the following data for processing:

  • Photos uploaded by the user (such as avatars and clothing items)
  • Images generated during try‑on sessions

Purpose
This data is used solely to generate virtual try‑on results within the app.

Data Retention
Images are retained for up to 72 hours solely for processing purposes and are automatically deleted thereafter.

Data Usage
Your data is not used for training machine learning models and is not used for any purpose other than generating your requested results.

Third‑Party Processing
We use trusted third‑party AI service providers, including FashnAI, to process this data. These providers are contractually obligated to handle your data securely and to provide a level of data protection equal to or greater than our own.

Security
All data is transmitted securely using HTTPS with TLS encryption.

User Control
You can withdraw your consent at any time by disabling "AI Processing Consent" in Settings. Once disabled, no further data will be sent for AI processing, and related features will be unavailable.

7. How Long We Keep Your Information

We retain personal information for as long as it is necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). Factors we consider when determining the retention period include the nature of the data, the purposes for which it is collected, legal obligations and the potential for disputes.

If you delete your account or request deletion of your personal information, we will remove your information from our active databases and instruct our service providers to do the same, except that we may retain certain information for fraud detection, legal compliance or other legitimate business purposes.

8. How We Keep Your Information Safe

We use a combination of physical, technical and administrative safeguards designed to protect the confidentiality, integrity and availability of your personal information. These measures include encryption of data in transit and at rest, secure software development practices, access controls and ongoing monitoring for unauthorized access.

Despite our efforts, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security and you acknowledge that you provide information at your own risk. In the event of a data breach affecting your personal information, we will notify you as required by applicable law.

9. Your Privacy Rights and Choices

Residents of certain U.S. states (including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia) have rights regarding their personal information. Subject to limitations and exceptions, these rights may include: (1) the right to know or access the personal information we collect and how we use it; (2) the right to request correction of inaccurate information; (3) the right to request deletion of your personal information; (4) the right to opt out of the sale or sharing of personal information; (5) the right to receive a portable copy of certain information; and (6) the right to non‑discrimination for exercising these rights.

We will confirm receipt of your request within 10 business days and respond within 45 days, subject to extension as permitted by law. Before fulfilling your request we may need to verify your identity to protect your privacy; if you submit a request on behalf of someone else, we may require proof of your authorization.

You may also manage certain preferences yourself within the application. You can review and update your profile information by logging into your account settings. You may opt out of marketing communications by following unsubscribe instructions in our emails. To opt out of the sale or sharing of personal information (for example, cookie‑based advertising) you may click the "Do Not Sell or Share My Personal Information" link on our website or adjust your privacy settings within the app once available.

10. Children’s Privacy and Minors

Our Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly. Parents or legal guardians who believe that their child has provided us with personal information may contact us at privacy@tryon.llc to request deletion.

If you are between 13 and 17 years old, you may use the Services only with permission and supervision from a parent or guardian. We do not currently have parental control features; by using the Services, you represent that you have obtained such permission. We do not knowingly sell or share the personal information of users under 16 for targeted advertising purposes.

11. Updates to This Privacy Notice

We may update this Privacy Notice from time to time to reflect changes in our practices, technologies or legal requirements. When we make material changes, we will post the updated notice and update the "Last updated" date above. We may also notify you through email or in‑app notifications. We encourage you to review this Privacy Notice periodically to stay informed about our information practices.
